These Terms and Conditions govern use of Guides.app, a SaaS marketplace platform owned and operated by Jiti LTD, England, United Kingdom.
1. Platform nature
Guides.app is a software marketplace for self-guided tours. It provides the platform only and does not supervise, control, or guarantee tours.
2. Eligibility
Users must be at least 18 years old and capable of entering into a binding contract.
3. User roles
The platform supports Tourists, Guides, and Organisations. Separate operational obligations may apply to Guides.
4. Accounts
Users must provide accurate information including name, date of birth, email address, and phone number, and must keep account credentials secure.
5. Guide responsibilities
Guides are independent providers and are responsible for the accuracy, legality, safety disclosures, and delivery of their tours.
6. Tourist responsibilities
Tourists are responsible for reviewing tour details, assessing suitability, and participating at their own risk.
7. Payments
Payments are processed through Stripe as a marketplace provider. Guides.app may charge commission on transactions.
8. Refunds
Refund terms are set by the Guide. Guides.app may assist in disputes but is not obliged to issue refunds.
9. Content ownership and licence
Users retain ownership of uploaded content, but grant Guides.app a worldwide, perpetual, royalty-free, transferable, sublicensable licence to host, use, reproduce, adapt, distribute, improve, and market the platform.
10. Reviews and moderation
Guides.app may moderate, investigate, remove, or restrict reviews and content that breach platform rules.
11. Suspension and termination
Guides.app may suspend or terminate accounts or remove content at its discretion where necessary for compliance, safety, fraud prevention, or platform integrity.
12. Liability
To the fullest extent permitted by law, Guides.app is not liable for the safety, accuracy, legality, or delivery of tours, nor for injuries or losses arising from participation.
13. Dispute resolution
Parties agree to attempt informal resolution for 30 days and then mediation before litigation where appropriate.
14. Governing law
These Terms are governed by the laws of England and Wales and disputes are subject to the courts of England and Wales.
